These conditions of sale are concluded on the one hand by the company Domaine Michel Arcelain with a share capital of 450,000 euros whose registered office is located in Pommard (21630) 9 rue mareau, registered with the Register of Commerce and Companies of Dijon under the number 882 511 975 hereinafter called "DOMAINE MICHEL ARCELAIN" and managing the site https://www.domainemichelarcelain.com  and, on the other hand, by any natural person over the age of 18 or legal person wishing to make a purchase via the website https://www.domainemichelarcelain.com  hereinafter referred to as "the buyer".

Article 1. Object 

These conditions of sale aim to define the contractual relationship between Domaine Michel Arcelain and the buyer and the conditions applicable to any purchase made through the website https://www.domainemichelarcelain.com. The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale, which the buyer acknowledges having read prior to his order. Before any transaction, the buyer declares on the one hand that the purchase of products on the site https://www.domainemichelarcelain.com  is not directly related to his professional activity and is limited to strictly personal use and on the other hand have full legal capacity, allowing him to engage under these general conditions of sale.

Article 3. Rates 

The prices appearing on the product sheets of the internet catalog and are prices in Euros (€) all taxes included (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be passed on to the price of the products. The Domaine Michel Arcelain company reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. For payment by credit card, Domaine Michel Arcelain uses the Stripe secure payment service, which incorporates the SSL security standard, in order to protect all data related to personal information and means of payment. If the payment is accepted, the order is recorded and the contract definitively formed. Payment by credit card is irrevocable.

 

- Secure payment by Paypal or credit card (via the PAYPAL system): the buyer selects the products he wishes to order in the "basket", modifies if necessary (quantities, references, etc.), checks the delivery address or report a news. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the method of payment of his choice: "Payment by Paypal". Article 5. Retention of title 

The Domaine Michel Arcelain company retains full ownership of the products sold until full payment of the price, in principal, costs and taxes included.

Article 6. Withdrawal

In application of the provisions of article L.221-18 of the Consumer Code, the customer has a period of fourteen days from the delivery of his order to return the delivered item for credit or reimbursement, at the choice of the customer, without penalty except for the cost of return.
 

The procedure to follow is as follows:

 

- The customer notifies his decision to withdraw via the form made available to him in article 13 or directly by contacting us (see our contact details in "contact") or by means of an unambiguous declaration specifying the contact details and allowing the identification of the products – in particular the number of the order concerned and the references of the products that he wishes to return.

Delivery times are only given as an indication; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. The company Domaine Michel Arcelain can provide the buyer by e-mail, if there is, the tracking number of his package. The buyer is delivered to his home. The risks associated with transport are the responsibility of the purchaser from the moment the items leave the premises of the company Domaine Michel Arcelain. The buyer is required to check in the presence of the delivery person's agent, the condition of the packaging of the goods and their contents upon delivery. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.

 

Article 8. Corked Bottles

Responsibility for corked bottles rests with Domaine Michel Arcelain. In case of cork taint, the procedure is as follows: return the bottle (full or almost full) and its original cork to us with an accompanying letter stipulating the purchase from our company. Upon receipt, we will judge the validity of the request and decide whether or not to replace it. Upon receipt of the response, we will let you know and in the event of a positive decision we will proceed with the replacement.

 

Article 9. Liability 

The company Domaine Michel Arcelain in the process of distance selling, is bound only by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems.

 

Article 10. Protection of minors.
